Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and Atlas AI (“Company,” “we,” “us”) governing your access to and use of the Atlas AI platform at atlas-ai.uk (“Service”).

By creating an account, connecting a social media account, or using any feature of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Service.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service.

Atlas AI is an AI-powered social media growth platform that enables users to:

• Connect social media accounts (currently Threads by Meta) via official APIs.
• Configure AI agents to generate, schedule, and publish content on their behalf.
• Discover relevant public posts for engagement and generate AI-drafted replies for review.
• Access analytics dashboards reflecting their social account performance.

The Service is provided on an “as is” and “as available” basis. Features may change at any time.

By connecting your social media account(s) to the Service, you voluntarily, knowingly, and explicitly authorize Atlas AI to:

• Access, read, and store your social media profile data, posts, and performance analytics.
• Create and publish posts on your connected social accounts according to your configured settings.
• Store encrypted access tokens required to authenticate on your behalf.
• Use your account’s historical data and performance metrics to personalize and improve the AI agent’s output for your account.

You acknowledge that:

• You are the rightful owner of or have full authority to connect the social media accounts you link to the Service.
• You are solely responsible for all content published through the Service, including AI-generated content that you approve.
• You must comply with the terms of service of each social media platform you connect, including the Threads Supplemental Terms and Meta Platform Terms.

You may revoke authorization at any time by disconnecting the integration in Settings or through the respective platform’s account settings. Revocation is effective going forward and does not entitle you to any refund or claim for prior authorized activity.

The Service uses artificial intelligence to generate content including posts, replies, and comments. You acknowledge and agree that:

• All AI-generated content requires your review and approval before publication (unless you have explicitly enabled automated publishing in your settings).
• You bear full and sole legal responsibility for any content published through your account, whether AI-generated or manually created.
• AI-generated content may contain inaccuracies, errors, or statements that do not reflect your views. You are responsible for reviewing content before approving it.
• The Company makes no warranty that AI-generated content will achieve any specific results, engagement levels, or business outcomes.
• You will not use the Service to generate or publish content that is illegal, defamatory, harassing, infringing, or violates any applicable platform’s community guidelines.

To provide a personalized and continuously improving experience, the Service uses your social account data, post performance metrics, audience engagement patterns, and approved content to fine-tune the AI agent behavior exclusively for your account.

By using the Service, you grant Atlas AI a limited, non-exclusive, royalty-free, worldwide license to process and use your data for this purpose. This license is limited to improving the Service for you and does not authorize us to use your data to benefit other users or to train general-purpose models.

This license terminates upon deletion of your account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at [email protected]. We are not liable for losses arising from unauthorized account use due to your failure to maintain credential security.

You may not use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Infringe intellectual property rights of third parties.
• Publish spam, deceptive content, or engage in coordinated inauthentic behavior.
• Circumvent platform rate limits or terms of service of connected platforms.
• Reverse engineer, decompile, or attempt to extract source code of the Service.
• Resell, sublicense, or commercially exploit the Service without written permission.

We reserve the right to suspend or terminate your account immediately for violations without prior notice.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

We do not warrant that: (a) the Service will meet your requirements; (b) results from using the Service will be accurate or reliable; (c) the Service will be available at any particular time; (d) AI-generated content will be error-free or achieve any specific performance outcome.

Atlas AI is an independent third-party application and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or any other social media company.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BENAUR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM:

• Your use of or inability to use the Service.
• AI-generated content published through your account.
• Actions taken by social media platforms (including account suspension) in connection with your use of the Service.
• Unauthorized access to your data due to security breaches beyond our reasonable control.
• Changes to or discontinuation of the Service or any third-party API.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Atlas AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content published through your account; (c) your violation of these Terms or any applicable law; (d) your violation of any third-party rights.

You may terminate your account at any time via account Settings. We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, or if required by law, without prior notice or liability.

Upon termination: your access to the Service ceases immediately, and your data is deleted per our Privacy Policy. Termination does not entitle you to a refund of any fees paid.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 7 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or class action proceeding.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Atlas AI regarding the Service and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force.

You have the right to request deletion of your account and all associated data at any time. This includes your profile information, connected social media tokens, published content history, analytics data, and AI training data specific to your account.

To submit a deletion request, visit our Data Deletion Instructions page. All data is permanently deleted within 30 days of a confirmed request.
